Callture’s #mybusinessVoIP Contest for End-Users


This Contest (the “Contest”) is sponsored and administered by Callture Communications Inc. (“Callture”), located at 2800 Skymark Ave., Suite 402, Mississauga, ON L4W 5A6. The Contest is governed by these official rules (“Official Rules”).  By participating in the Contest, each entrant (“Entrant”) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the result of the Contest, as determined by Callture or its agents, are final in all respects.

Contest Period: Entries will be accepted online starting on September 16, 2019 at 9:00 am Eastern Time and ending October 7, 2019 at 5:00 pm Eastern Time. All online entries must be received by October 7, 2019 at 5:00 pm Eastern Time.

Eligibility: This Contest is open only to Callture’s VoIP Clients who complete the four steps below, are 18 years or older as of the date of entry, and submit their entry here. The Contest is only open to legal residents of Canada and is void where prohibited by law. Employees of Callture and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest.

How to Enter: The Contest must be entered by completing the following steps:

Step 1: Write a review of Callture on one or more of the following 6 websites:

The more websites on which an entrant writes a review of Callture, the more points they will receive.

Step 2: All entrants must follow Callture on the Social Media platforms with which they have accounts (Facebook, Twitter, LinkedIn).

Step 3: Tweet about an impressive achievement of your company (such as your customer satisfaction rate, a testimonial, or a story about a happy customer) that Callture enabled you to achieve. Tag @CalltureVoIP and include #mybusinessVoIP (Twitter).

The more engagement clients have with this tweet, the more points they will get. Engagements happening after 5 PM Eastern Time on October 7, 2019 are not eligible for points.

As soon as Callture receives your submission, you will receive a $5 credit on your account.

By entering the Contest, Entrant hereby grants Callture a worldwide, exclusive, perpetual, unlimited license and right to use, modify, transfer, assign, publish and promote any Entry in its sole discretion without any additional payment, consideration, royalty or notice to Entrant. By entering the Contest, you represent and warrant that you are (a) the sole author of the tweet, (b) authorize Callture to use, analyze, modify and publish your name, tweet and any other information provided by you at Callture’s sole discretion, including publication in its marketing and promotional materials; and, (c) authorize Callture to contact you regarding Callture offerings, products and services.

Winner: One (1) Prize winner (a “Winner”) will be determined based on the most points achieved during the contest period. If there is a tie, the entrant that submitted the completion form earlier wins. The Winner will be announced on social media on October 8th, 2019.

The entries will be monitored in the following manner:

Odds of winning depend on the number of eligible entries received.  In order to claim prizes, the Winner may be required to complete an affidavit or declaration of eligibility, liability which must be signed and returned to Callture within seven (7) days of date printed on the notification provided by Callture, or an alternate Winner will be selected. If a selected Winner is deemed ineligible, the Entry will be disqualified and an alternate winner will be selected. Callture is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the Winner. The prize will only be mailed to the Winner at the physical address provided by the Entrant on the affidavit or declaration of eligibility form.  A Prize or Prize notification that is returned as undeliverable will disqualify the Winner, and the Winner with the next highest number of points will be selected by Callture. Accepting and/or using Prizes constitute permission (except where prohibited by law) for Callture to use the Winner’s photo, name, voice, hometown, and/or likeness for promotional purposes without further compensation. By accepting a Prize, the Winner waives the right to 1) assert as a cost of winning the Prize any and all costs of verification and redemption or travel to redeem said Prize, and 2) claim any liability (including attorney’s fees and costs) which might arise from redeeming, seeking to redeem said Prize (including any travel related thereto) or any use of the Prize.  Callture will not replace any lost or stolen Prize, including if lost during delivery. Risk of loss passes to the Winner upon dispatch of the Prize from Callture’s offices. The actual delivery of Prizes by Callture to a Winner may be delayed for reasons outside of the control of Callture (including but limited to the postal or deliver services, back ordering, cancelation and the like). Callture is not responsible for any delay in the delivery of any Prize to any Winner.

Prize: The Winner will receive a $200 gift card.

No alternative prize(s), cash equivalent, or other substitution is permitted except as determined solely by Callture. All Prizes are non-transferable and non-assignable. Prizes are provided “as is.” Callture disclaims all warranties, express or implied with respect thereto, including without limitation any implied warranties of merchantability, fitness for a particular purpose and noninfringement. Entrants acknowledge that Callture and Callture Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a Prize or regarding the use, value or enjoyment of the Prize.

Conduct: By entering this Contest online, you agree to be bound by these Official Rules. Callture reserves the right at its discretion to disqualify any individual it finds to be tampering with the Entry process or other factors which may cause unfair advantage in the Contest; the operation of the Callture website; to be acting in violation of the Official Rules, Callture’s Privacy Policy, LinkedIn’s terms of use or other service agreement(s); Twitter’s terms of use or other service agreement(s); Facebook’s terms of use or other service agreement(s); or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by a entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made, Callture reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including all attorney’s fees.

Agreement to Rules: By participating, the Entrant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Callture as final and binding as it relates to this Contest.

Disputes: THIS Contest IS GOVERNED BY THE LAWS OF Canada. As a condition of participating in this Contest, Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ontario having jurisdiction. Further, in any such dispute, under no circumstances shall Entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The Entrant further waives all rights to have damages multiplied or increased.

General: Any and all decisions related to the Contest, these Official Rules, Contest administration, verification and the like will be supervised by Callture, whose decisions are absolute and final in all respects. Callture assumes no liability for damage caused to Entrant’s or any other person’s/entity’s computer hardware, software or communications network, video recording device or other personal property regardless of cause. Callture reserves the right in its sole and absolute discretion to terminate (and not award any prizes to any entrant)/cancel or modify the Contest at any time and from time to time for any reason or no reason without or without notice or to disqualify any entrant at any time and from time to time for any reason or no reason with or without notice in its sole judgment, including if, in Callture’s sole and reasonable judgment, it determines that the integrity or fairness of the Contest has been, or could be, compromised or that the Contest is not capable of running as planned or fairly, including infection by computer virus, bugs, tampering, unauthorized intervention (hacking), fraud, technical failures, force majeure or any other cause. In the case of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by name of the account holder for the email address on the registration form.   Callture or the Callture Entities shall not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.

All trademarks are and shall remain the sole and exclusive property of their respective owners. The use of certain products and services as prizes does not imply participation in, or approval of, this Contest by their respective companies.  This Contest is sponsored and administered exclusively by Callture and is in no way sponsored, endorsed, administered by or associated with Twitter, Facebook, LinkedIn, or any other company.
